Purchasing from us
To purchase from us you must be over 18 years of age. Currently, we can only ship to limited countries (please check countries on checkout of web site). By submitting your order you are offering to buy the goods at prices and terms as stated, and allowing us to use your personal details for the purposes of supplying goods (including passing your details onto couriers and other subcontractors). We will not use your details for other purposes without asking your consent and you may ask that your details are removed from our system by writing to the address above. We are not obliged to supply the goods to you until we have confirmed acceptance of your order - Your order is deemed accepted when you receive a confirmation for despatch of goods, this is when the contract is made. You do not own the goods until we receive payment in full. If you discover you have made a mistake with your order please contact Customer Care immediately. Please do this before we confirm your order. If you order software from us you will also be bound by the terms of the software licence supplied with the software.

Product images displayed are for illustration purposes only and may differ from actual products received. KM Gifts endeavour to supply goods as per images shown, however manufactures do vary design and packaging and we reserve the right to supply identical items with alternative packaging without prior notice to the customer. Dye codes listed may differ from actual products received. KM Gifts endeavor to supply correct information for all its products but can not guarantee the accuracy of the dye codes listed on our website. If you receive any media with a different dye code then please inform us and we will endeavor to correct any incorrect products.

Prices and Payment
All goods are priced inclusive of VAT if applicable at the Applicable Rate, unless otherwise stated. For out of stock items, delivery dates given are only estimates. Prices are shown in UK pounds sterling and will be billed in UK pounds sterling. If your credit card company operate in a different currency, your credit card company will convert payment from UK pounds sterling to your local currency at their current conversion rate.
All prices and offers are subject to change, and availability. Prices are checked regularly, however, Whilst every effort is made to eliminate errors in pricing, sometime errors do occur.
Credit Card Security
Once you have gone through our checkout, you will be diverted to our protected secure online payment system with our payment processor, Your payment details information will be held in protected SSL secure servers, we will not have access to your full credit card details, and we will not release information regarding your credit card. Your credit card details will only be used for transaction authorised by you.
We currently only accept VISA, MasterCard, VISA Delta, Switch/ Maestro, Switch Solo and PayPal.
(IMPORTANT NOTE: customers using Switch/Maestro should supply a "Start/Issue Date" and an "Issue Number" for the card where applicable, as well as card number and expiry date.)
Cooling-Off Period
By law you have the right to cancel any order within 7 working days of the day after the item is delivered to you. the right to cancel does not include certain goods or services i.e audio or video recordings or computer software if they are unsealed by the consumer. You need to write to us at :

We will refund your money less any delivery costs, All we ask is please take care of our goods, ensure all items are complete are in their original packaging, unused and in resalable condition. For your protection, please send items back well packaged and using a recorded delivery service.
If you do not return the goods within 21 days of cancellation we will collect the goods from you at your cost and will deduct the cost of collection from your refund, or if requested we will arrange collection of items at your cost.
All monies paid for cancelled goods will be refunded within 30 days from date of cancellation.
Please note: It is a legal requirement that you take care of the goods and you are responsible for the carriage costs of returning goods to us unless we delivered goods to you in error, or if goods are faulty.

Delivery
Over 98% of KM Gifts orders processed before 3pm are delivered within 3-4 days, Subject to the following.
km-gifts.co.uk will endeavour to dispatch any order placed before 4pm by Royal Mail.
We aim to deliver goods to you within the time scale indicated but we cannot give an exact delivery time or date. We also may deliver the goods in several consignments, but will not charge any extra delivery for this.
You will be informed by e-mail when your goods have been dispatched from our warehouse.
Should you have any problems

* If you do not receive your goods within 7 days.
* You have items missing or your goods are damaged from delivery.
Please contact us immediately via the contact us page. If you do not contact us within seven working days from date of receipt, we may assume your goods have been delivered in perfect condition.
If we have not dispatched the goods within 30 days of expected delivery then you may cancel the contract. We will refund any monies paid by you.
If delivery your goods was attempted and no recipient was available to take delivery, they will take your goods back to the local depot and hold your package for upto 3 working days, if the package has not been successfully delivered within the time given the order will be returned back to us and classed as a failed delivery. If you order has been classed as a failed delivery, we can either re-send your order (at your cost) or a refund will be issued for the order less any delivery costs incurred by us.

Damaged or defective goods
You should inspect your goods immediately upon delivery for defects, damages or shortage. Please note images used on our web site are for illustration purposes only and may differ from actual products received. If you find any defects or damages you must inform us by write to us as soon as possible and we will arrange the return of your goods, either to us, or the manufacturer. Warranty on all items, are RTB (Return to Base) excluding items damaged in transit, (these will be replaced at no cost to you). If the goods are found to be damaged or defective prior to delivery to you, we will repair or replace the goods or refund the price paid by you.
All hardware must be in their original condition, at date of receipt. Any modifications may invalidate warranties for the hardware. Flashed or modified hardware using authorised or unauthorised firmware is done at your own risk, and we cannot be held responsible for your actions in doing so. You will be required to send faulty flashed or modified hardware direct to manufacturer for repair or replacement.
km-gifts.co.uk cannot be held responsible for losses or damages arising from failures of used or 2nd user goods supplied.
Your statutory rights as a consumer is not affected by this
Business customers
If you are a business or if the goods are used wholly or in part for business purposes we shall not be liable to you for any business loss including loss of profits (whether direct or indirect) business data, revenue, goodwill, or incidental, or consequential loss that you may suffer as a result of the purchase of goods from us. Any other liability shall be limited to the price paid for the goods. We do not exclude our liability for fraud or for death or personal injury. For our performance time is not of the essence. Returns are subject to a 15% Handling fee. You will not export any goods purchased from us in contravention of any International laws & by laws.

We advise you to print and keep safe a copy of these Terms and Conditions. Please send goods back to us using recorded delivery with insurance, we can not be held responsible for goods damaged in transit whilst returning to us.

We do not and will not sell or release information provided by you to any other third parties, except when in connection with your orders, or in exceptional cases of debt recovery. Unless required by law.
